These Terms and Conditions (hereinafter the "Terms") govern the access and use of the website moneticaplnvz.com and the real estate crowdlending services offered by Moneticaplnvz SpA (hereinafter "Moneticaplnvz" or "the Platform"). By accessing or using our services, you agree to be bound by these Terms.

2. Service Description

Moneticaplnvz operates a digital platform that facilitates collective investment in real estate projects in Chile through the crowdlending model. The Platform connects investors with real estate project developers, enabling participation in investment opportunities that might otherwise be individually out of reach. Moneticaplnvz acts as a technological intermediary and is not a financial institution regulated by the Financial Market Commission (CMF).

3. Requirements for Use

To use Moneticaplnvz services, you must: be over 18 years of age, be a tax resident in Chile or have a valid RUT, provide truthful and up-to-date information during the registration process, comply with applicable laws regarding investments and taxation, and have the financial resources you allocate to investment without compromising your financial stability.

4. Investment Risks

Investments made through Moneticaplnvz carry inherent risks, including but not limited to: partial or total loss of invested capital, delays in the execution of real estate projects, variations in estimated returns, risks associated with the Chilean real estate market, and illiquidity of investments during the project term. Moneticaplnvz does not guarantee returns or capital recovery. Past returns are not indicative of future results. The information presented on the Platform does not constitute financial, legal, or tax advice.

5. User Obligations

By using the Platform, you agree to: provide truthful, complete, and up-to-date information, not use the Platform for illicit or fraudulent activities, maintain the confidentiality of your access credentials, immediately notify Moneticaplnvz of any unauthorized use of your account, and comply with all applicable laws and regulations in Chile.

6. Intellectual Property

All content on the website, including but not limited to text, graphics, logos, icons, images, software, and source code, is the property of Moneticaplnvz SpA or its licensors and is protected by Chile's intellectual property laws and applicable international treaties.

7. Limitation of Liability

Moneticaplnvz shall not be liable for: indirect, incidental, or consequential damages arising from the use of the Platform, financial losses resulting from investments made, technical interruptions or failures in the service, actions or omissions of project developers, or force majeure events affecting project operations.

8. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Republic of Chile. Any dispute arising from these Terms shall be submitted to the jurisdiction of the ordinary courts of the city of Santiago, Chile, with both parties waiving any other jurisdiction that may correspond to them.

9. Modifications

Moneticaplnvz reserves the right to modify these Terms at any time. Modifications will take effect upon publication on the website. Continued use of the Platform after publication of changes constitutes acceptance of the modified Terms.
